Terms of Service

These terms govern your use of lamercreme.com and any purchase you make from us. By using this website or placing an order you agree to them. Please read them together with our Returns & Refund Policy, Shipping & Delivery and Privacy Policy.

1. Independent retailer — no brand affiliation

La Mer Crème is an independent retailer of genuine La Mer products. We are not affiliated with, endorsed by, sponsored by, or an authorised dealer for Crème de la Mer or The Estée Lauder Companies Inc.

"La Mer", "Crème de la Mer" and "Miracle Broth" are trademarks of their respective owners. We use these names only to describe the genuine products we resell, as permitted by law. Products bought here are covered by our own guarantees, not by a manufacturer warranty, and cannot be returned or serviced through La Mer boutiques or authorised stockists.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that the payment method you use is your own.

3. Products

All products we sell are genuine, brand new and factory sealed. We do not sell testers, refills, decants, counterfeits or expired stock. See our Authenticity Guarantee.

We make every effort to display products accurately, but colours and packaging may vary slightly from images on screen, and manufacturers may update packaging without notice. Product descriptions are provided for general information and are not medical advice. Skincare products are for external use only. If you have a known allergy or a skin condition, patch test first and consult a qualified professional.

4. Pricing

All prices are shown in US dollars and exclude any duties or taxes that may apply at your destination.

Where we show a struck-through comparison price, this is the recommended retail price at which the product is generally sold by the brand or its authorised stockists. It is a reference point, not a price at which we have previously sold the item.

We reserve the right to correct pricing errors. If a product is listed at an obviously incorrect price, we may cancel the order and refund you in full rather than fulfil it.

5. Orders

Your order is an offer to buy. A confirmation email acknowledges receipt but does not create a contract. The contract is formed when we dispatch your order.

We may decline or cancel an order where the item is out of stock, where we suspect fraud, where a pricing error has occurred, or where quantities appear intended for resale. If we cancel, we refund you in full.

6. Payment

We accept major credit and debit cards and the express payment methods shown at checkout. All payments are processed through a secure, PCI-compliant, SSL-encrypted checkout. We never see or store your full card details.

7. Shipping and returns

Delivery timeframes are set out in our Shipping & Delivery policy. Your right to return is set out in our Returns & Refund Policy — in short, 14 days from delivery for unopened, sealed items.

8. Acceptable use

You agree not to use this site to break any law, to attempt to gain unauthorised access to it, to interfere with its operation, or to scrape, copy or republish its content for commercial purposes without our permission.

9. Our content

The layout, original text, photography and design of this site belong to us or our licensors and may not be reproduced without permission. Third-party trademarks and product imagery remain the property of their owners.

10. Reviews and submissions

If you submit a review or other content, you grant us a non-exclusive right to display it on the site. We may remove content that is unlawful, abusive, or misleading.

11. Disclaimers and liability

The site is provided on an "as is" basis. We do not warrant that it will be uninterrupted or error-free.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded. Subject to that, our total liability arising from any order is limited to the amount you paid for that order.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer, this does not remove any protection you have under the mandatory consumer law of the country where you live.

13. Changes

We may update these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order.
